What Actions are Protected from Reprisal

How am I protected?

A current or former BC public service employee who reports wrongdoing, seeks advice, or cooperates with an investigation under PIDA is legally protected from reprisal. It is an offence to take, threaten to take, counsel, or direct reprisal against an employee.

To be protected, an employee must have:

Sought advice from:

  • the employee's union representative or employee association representative, as applicable
  • a lawyer
  • the employee's supervisor
  • the Designated Officer in their organization
  • the Ombudsperson

Reported the wrongdoing to:

  • the Ombudsperson
  • the employee’s supervisor
  • the Designated Officer in their organization

Cooperated in an investigation.
